EHCP - please can someone explain how to lodge an appeal against a Final ECHP ? The Final EHCP was issued mid Nov 2017, and I believe there is a deadline of mid January for appealing - does that sound right ? (Asking for a friend)

Mediation must at least be considered before an appeal to the  Special Educational Needs and Disability Tribunal (SENDIST)  can be started. This does not apply when the appeal is about the school placement only.

Before you can appeal you must first make contact with the mediation service. You will have to do so within two months of the date on the decision letter sent by the local authority.

When the local authority writes to you with a decision it must also set out details of the local mediation service that it has decided to use.

Once you have either completed mediation, or informed the mediation service that you do not want to go through with mediation, you will be issued with a Mediation Certificate. You will need to send this along with your appeal papers to the SENDIST to start an appeal.

If your case is one which requires a mediation certificate, your deadline to appeal is either two months from the date of the decision made by the local authority, or one month from the date of the mediation certificate, whichever is later.
